This document is a public offer by ะคะžะŸ ะ“ะพะฝั†ะฐ ะะฝะดั€ั–ะน ะ’ะฐะปะตั€ั–ะนะพะฒะธั‡ (the Provider) to enter into an agreement for access to the online service SeeYou on the terms below. Under Articles 633 and 641 of the Civil Code of Ukraine the agreement is concluded once the offer is accepted.

1. Definitions

  1. Service โ€” the online service SeeYou at https://seeyou.com.ua for online booking, a bookings calendar, a client base and notifications.
  2. User โ€” an individual, a sole proprietor or a company that has registered a business in the Service.
  3. Business โ€” the User's booking page and dashboard in the Service together with its staff, services, schedule, bookings and clients.
  4. User's clients โ€” people who book with the User through the Service.
  5. Subscription โ€” a paid period of access to the Service.

2. Subject

  1. The Provider gives the User access to the Service for the Subscription period, and the User pays for it on the terms of this agreement.
  2. Access includes every feature of the Service, with no limits on the number of staff or bookings.
  3. The Service is provided "as is". The Provider keeps improving it and may change, add or remove individual features without impairing its main purpose.

3. Acceptance

  1. Registering a business in the Service accepts this offer. By registering, the User confirms having read and agreed to this agreement, the Privacy policy and the Payment and refund terms.
  2. The User warrants the right to enter into this agreement and that the registration details are true.

4. Free trial

  1. After registering, the User gets a free trial of 30 calendar days with full access to the Service. No bank card is needed for the trial.
  2. When the trial ends without payment, online booking and adding new bookings close. The User's data is not deleted.

5. Price and payment

  1. The Subscription price is shown on the website under "Price". At the time of this edition it is 149 โ‚ด a month or 1 490 โ‚ด a year for the whole business, whatever the number of staff.
  2. Payment is made by bank card through the payment service of a partner bank. Card details are entered on the bank's page; the Provider neither receives nor stores them.
  3. By choosing automatic renewal, the User instructs the Provider to charge the price of the next period to the same card on the day the current period ends. The date of the next payment is shown in the dashboard. Automatic renewal can be switched off in the dashboard at any time; the period already paid stays valid to its end.
  4. If a charge fails, the Provider retries over several days and informs the User. If no payment arrives, online booking closes at the end of the paid period until payment.
  5. The Provider may change the price with at least 30 days' notice. The new price applies from the next payment period; a period already paid is not recalculated.

6. Rights and duties of the Provider

  1. Keep the Service running and store the User's data securely.
  2. Not pass the data of the User and the User's clients to third parties except as described in the Privacy policy or required by law.
  3. Carry out maintenance, giving advance notice of long interruptions where possible.
  4. Restrict access for a User who breaks this agreement or the law, or uses the Service for spam, fraud or other unlawful acts.

7. Rights and duties of the User

  1. Use the Service for its purpose and within the law.
  2. Keep the password safe and answer for the actions of staff given access.
  3. Set services, prices, schedule and booking rules and answer to the User's clients for the services provided.
  4. Send news to clients only about the User's own services and work, with no spam or third-party advertising, and answer for its content. The Provider limits the number of news messages and may switch them off for a User whose clients complain.
  5. Download the data (bookings and a backup of the business) at any time and stop using the Service.

8. Personal data of the User's clients

  1. For the personal data of the User's clients, the User is the controller and the Provider is the processor that handles it only to run the Service on the User's behalf.
  2. The User answers for collecting clients' data lawfully and for informing them about its processing.
  3. Processing of personal data is described in detail in the Privacy policy.

9. Liability

  1. The Provider is not liable for losses caused by failures of the internet, mail services, Telegram or banks, or by actions of the User, the User's staff or clients.
  2. The Provider's total liability is limited to the amount the User paid for the last paid period.
  3. Neither party is liable for failing its obligations because of force majeure.

10. Term and termination

  1. The agreement is valid from acceptance until either party ends it.
  2. The User may end the agreement by switching off automatic renewal and stopping use of the Service, or by writing to the Provider.
  3. After the Subscription ends, the User's data is kept. Before deleting the data of an inactive business, the Provider warns the User by email at least 30 days in advance.
  4. Refunds follow the Payment and refund terms.

11. Other terms

  1. The Provider may change this agreement by publishing a new edition on the website. Users are told about significant changes by email. Continuing to use the Service after a new edition takes effect means agreeing to it.
  2. Disputes are settled by negotiation and, failing agreement, under the law of Ukraine.
  3. Emails to the address given at registration count as written notice.
